These Terms of Service ("Terms") govern your access to and use of FSHNTRP.au (the "Platform"). By using the Platform, you agree to be bound by these Terms. If you do not agree, please do not use the Platform.
1. Definitions
- "Platform" means FSHNTRP.au, operated by FSHNTRP.
- "Operator" means a charter business that lists trips on the Platform.
- "Customer" means a user who browses or books a charter trip.
- "Booking" means a request to reserve a charter trip with an Operator.
2. Eligibility & Accounts
You must be at least 16 years old to create an account. You agree to provide accurate, current information when registering and to keep your password secure. You are responsible for all activity under your account.
3. Use of the Platform
- Use the Platform only for lawful purposes and in compliance with these Terms.
- Do not impersonate another person or misrepresent your affiliation.
- Do not attempt to disrupt, hack, or reverse-engineer the Platform.
- Do not use the Platform to send unsolicited communications or spam.
4. Charter Listings
Operators are responsible for the accuracy of their listings, including pricing, availability, vessel details, and policies. FSHNTRP.au vets operators but does not guarantee the quality or safety of any charter. Operators must hold all required licences, permits, and insurance to operate legally.
5. Bookings & Payments
- A Booking request is subject to approval by the Operator. No trip is confirmed until the Operator accepts.
- Payments are processed securely via Stripe. A deposit may be required to confirm a Booking.
- FSHNTRP.au charges a commission on completed Bookings, deducted from the Operator's payout.
- Cancellation and refund terms are set by the Operator in their listing; please review them before booking.
6. Operator Sign-Up Fee
Operators may be charged a one-time sign-up fee as published on the Platform at the time of registration. The fee is non-refundable except where required by law.
7. Reviews
Customers may leave reviews for charters they have booked. Reviews must be honest and based on genuine experiences. We may remove reviews that are false, abusive, or violate these Terms. Operators may respond to reviews but may not offer incentives for positive reviews.
8. Intellectual Property
All content on the Platform, including logos, text, and design, is owned by FSHNTRP.au or its licensors. You may not copy, reproduce, or distribute Platform content without permission. Operators retain ownership of their listing content and grant us a licence to display it on the Platform.
9. Third-Party Services
The Platform integrates with third-party services including Google (sign-in and analytics) and Stripe (payments). Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the practices of third-party providers.
10. Disclaimers
The Platform is provided "as is" without warranties of any kind. We do not guarantee that every charter will be available, safe, or as described. You participate in charter trips at your own risk. To the maximum extent permitted by law, FSHNTRP.au is not liable for any injury, loss, or damage arising from a charter trip or use of the Platform.
11. Limitation of Liability
To the extent permitted by law, FSHNTRP.au's total liability for any claim arising from your use of the Platform is limited to the amount you have paid us in the preceding 12 months, or AUD $100, whichever is greater. We are not liable for indirect, incidental, or consequential damages.
12. Termination
We may suspend or terminate your account at any time if you breach these Terms or if we believe your conduct harms the Platform or other users. You may close your account at any time. Sections that by their nature should survive termination will remain in effect.
13. Changes to These Terms
We may update these Terms from time to time. We will update the "Last updated" date above and, for material changes, notify you through the Platform. Continued use after changes constitutes acceptance of the revised Terms.
14. Governing Law
These Terms are governed by the laws of Australia. Any disputes will be resolved in the courts of the jurisdiction in which FSHNTRP.au operates.
